Artículo 38 Ley General de la Vivienda Las viviendas que el Estado construya o queden a su disposición serán asignadas por el órgano local del Poder Popular correspondiente, observando la política y el orden de prioridades. Modificado por el Decreto Ley No. 342 “Modificativo de la Ley General de la Vivienda” dispone la modificación del artículo 70, donde se adiciona el apartado 6, que establece los propietarios de viviendas asignadas por Acuerdo del órgano local del Poder Popular o de las construidas totalmente con subsidio estatal, si deciden trasmitirlas en concepto de Compraventa o Donación en los primeros quince (15) años de su adquisición, están obligados a ingresar al Presupuesto del Estado el monto total subsidiado, de acuerdo con los principios establecidos

The legal regime of the parcels and state wastelands that are assigned is by way of Perpetual Surface Law, and may be granted to several natural persons to build their homes in the same building and to a natural person to build a single-family home.
The plots to be delivered will have a dimension between 80 and 150 m².
Natural persons submit their request to the Physical Planning Officer (OGTV). The file will contain the application and its justification, the applicant's first and last name, identity card, home address, place of location, composition of the family nucleus and sworn declaration that he does not own another home or is a land owner of a parcel or wasteland to build housing by own effort.

Artículo 78.1 Ley General de la Vivienda en relación con la Resolución V-001/2014 Artic. 12 transmisiones de la propiedad de la vivienda en los casos de fallecimiento de sus propietarios.

Si al fallecer su propietario no existieran herederos, o estos renuncien a la herencia, y la vivienda hubiere estado ocupada permanentemente por otras personas, la propiedad se transferirá al Estado.

Documentos que debe presentar:

  • Titularidad de la vivienda (copia).

Para la división de viviendas es necesario un dictamen jurídico y tasaciones (una por cada vivienda resultante de la división) por lo que le monto total del servicio dependerá de la sumatoria de los valores por lo que no se puede dar un valor fijo pues pueden existir varias combinaciones.
